Liability for Moving and Transport Services
1. Statutory Liability for Moves (§§ 451 ff. German Commercial Code (HGB))
The special statutory provisions of §§ 451 to 451h of the German Commercial Code (HGB) apply to moving contracts.
The liability of Schwalbe Moving Company for loss or damage to the moving goods is legally limited to:
€620.00 per cubic meter of transported goods required to fulfill the contract (§ 451e HGB).
This limitation of liability does not apply in case of:
- Intent
- Gross negligence
- Injury to life, body or health
2. Exclusions of Liability according to HGB
Liability is particularly excluded if the damage was caused by:
- Inadequate packaging or labeling by the client
- Special nature of the moving goods (e.g., fragile, sensitive or perishable goods)
- Natural or defective condition of the goods
- Acts or omissions of the client
- Force majeure
3. Valuable and Sensitive Items
The statutory liability framework does not particularly cover:
- Cash, jewelry, documents, securities
- Art objects of exceptional value
- Data carriers without backup
- Precious metals or comparable valuables
Such items must be separately declared and separately insured by the client.
4. Additional Insurance
Extended transport insurance can be taken out at the client’s request.
Without express order, the transport is carried out within the framework of the statutory basic liability according to HGB.
Externally visible damage must be reported in writing no later than the day of delivery.
Non-visible damage must be reported in writing within 24 hours of delivery (§ 451f HGB).
After expiry of these periods, the goods are deemed to have been delivered in accordance with the contract.

- the statutory provisions of the German Commercial Code (HGB)
